BALI STATE SECONDARY SCHOOL BANS FEMALE STUDENTS FROM WEARING HIJAB

Denpasar , 2 Rabi al-Awal 1435/5 January 2014 ( MINA ) – A state secondary school, SMA Negeri 2 (SMAN 2) Denpasar, in Bali, Indonesia prohibits muslimah student wearing the hijab while in school.

Anita Whardani, a-17-years old- female student of the school come to the blind alley after she had not reached deal with the principal. But, she determined to file a lawsuit with the help lawyers from Regional Board Indonesian Islamic Student (PW PII).

 The principle of SMAN 2, Ketut Sunarta said: “The school banned the hijab wearing because it will cover the school logo which put on the chest. It has been two and half years our school run the law”.

In the lawsuit report received by Mi’raj Islamic News Agency (MINA), Saturday (4/1) , Anita (now in the third grade) has been banned from wearing the hijab since the beginning she entered to the school, two years ago (2011).

Anita stated many students do not dare to wear the the Muslim headscarf while in school. The principal scolds the female student if they wear it while in school . Anita also claimed that the school demanded her to move to other schools if she still wants to wear hijab.

The prohibition of wearing hijab in school violates human rights.  The 1945 Constitution, Article 28, 29 and 31 and the Education Law (UU SISDIKNAS) year 2003 number 20 give guarantees to every student with different backgrounds of ethnic, , religions, and races have the same rights and obligations in studying in the public school.

The Circular of Education affairs ministry, No: 1174/C/PP/2002 dated on March 11, 2002 also mentions female students may use a hijab with the shape and design are handed over by the school by involving the School Committee . While in Islam, wearing hijab is obligatory for Muslim women to cover from head to chest.

The ban of wearing hijab also jolted Indonesia when the policewomen are prohibited to wear it while on duty. Even though the police chief, Sutarman had approved the law, but the decision had been withdrawn. They claimed, the proper design was  not found yet. ( L/P04/E1) .
