Jakarta, MINA – Coordinating Minister for Law, Human Rights, Immigration, and Corrections Yusril Ihza Mahendra said the three suspects in the wiretapping case against President Prabowo Subianto have not been charged with treason.

Yusril explained at a press conference in Jakarta on Tuesday evening, November 3, that the suspects are currently charged under wiretapping or interception provisions: Article 258 of the Criminal Code, which carries a maximum penalty of 10 years in prison; Article 332 paragraphs (1) and (2) of the Criminal Code, which carries a maximum of 6 years; and Article 32 paragraph (1) of the Electronic Information and Transactions Law, which carries a maximum of 8 years.

He stressed that investigators have not applied any articles related to treason.

According to Yusril, the Criminal Code recognizes three categories of treason: treason against the president, treason against the government, and attempts to separate parts of the national territory. He stated that so far there has been no indication pointing in that direction, because the investigation remains limited to wiretapping and illegal access.

He identified suspect LSP as an active police general, while the two other suspects, identified as AS and EH, hold the rank of inspector general, equivalent to two stars. All three have been detained.

Yusril asked the public to be patient and wait for National Police Headquarters to explain the substance and purpose of the wiretapping. According to him, this cannot yet be announced because the investigation is still at an early stage.

Previously, Criminal Investigation Department chief Commissioner General Asep Safrudin explained that the suspects allegedly ordered wiretapping without following procedures during 2025 and 2026. A number of phone numbers, including the president’s phone number, were entered into the National Police’s interception equipment without verification and without any connection to the law enforcement process.

In October 2026, the suspects allegedly deleted files containing the results of the wiretapping. Officers who became aware of this reported it on October 30, 2026.

Investigators have examined 10 witnesses and three expert witnesses. Evidence seized includes 11 mobile phones, one iPad, and four flash drives.

The suspects were named on Tuesday: General Listyo Sigit Prabowo, the former National Police chief who now heads the Presidential Staff Office; Inspector General Ahrie Sonta Nasution, head of the National Police Legal Division; and Inspector General Eko Hadi Santoso, a senior instructor at the Police Education and Training Institute. A fourth individual, identified as SU, is still being questioned as a witness.

The decision not to pursue treason charges is significant given the political sensitivity of the case. Wiretapping the president’s phone could in principle be framed as an attack on the state, but prosecutors have so far confined the allegations to interception, data deletion, and illegal access, all of which carry substantial but narrower penalties. Yusril’s public clarification appeared aimed at cooling speculation that the case represents an attempt to undermine the government, while leaving open the possibility that the investigation could expand as more evidence emerges.

The case has also drawn attention to the internal workings of the police institution, given that a former police chief and two serving two-star generals stand accused of ordering surveillance outside legal channels. National Police Headquarters has not yet disclosed what the intercepted conversations contained or why the numbers were targeted.[]
